After updates startx reports graphics device is "busy" and server crashes with "screeninit failed for driver 1" #1232

I am running gentoo, updated my system on Tuesday night and when trying to restart X11 after update it would only give me the mentioned error.
the attached pictures are unfortunately the best I can do in order to showcase my issue. one of startx output the second of the X log piped through grep to show errors.
Steps to reproduce
unsure. happened after a system update. considering the time i spent troubleshooting anything else that could've caused this before coming here, the specific packages I do not remember.

The gentoo ebuilds seemingly still use git master, as mine still say version 9999.
If the full X11 log or my Gentoo specific options such as emerge info or make.conf are needed, please let me know so I can paste them up and add them to the thread.
